Dear Physician:
It has come to my attention that Axiom
worldwide and/or their sales agents are
using deceptive practices and untrue
statements in trying to compete with
Hako-Med’s proprietary technology. Here
are some important facts you need to
know to safeguard yourself from what in
my opinion appears to be potential
fraud. Unfortunately over the years a
few companies have unsuccessfully tried
to imitate Hako-Med’s patented
technology, one was criminally convicted
in 1999. If any claims are being made in
comparison to our system please have
those claims given to you in writing and
provide them to us so that we may
initiate legal action.
1. Hako-Med is the only company that
provides Horizontal Therapy. Horizontal
Therapy is patented in the United States
under patent number 5,576,552.
2. Hako-Med has documented its long term
efficacy in many published clinical
studies. There is no other treatment
known to date able to achieve the same
long-term efficacy as Horizontal Therapy
in the treatment of pain from
osteoarthritis.
3. Axiom cannot comment on the long term
effects of their system because they do
not have any published clinical studies
utilizing their system. If they tell you
otherwise please ask them to provide
copies documenting research specific to
their system.
4. Digital vs. Analog. Hako-Med’s PRO
ElecDT system does in fact use digital
technology. However, it is my opinion
that digital technology vs. analog is an
unfortunate marketing ploy by Axiom to
try to deceive you. Again, ask them for
any published studies showing that
digital technology makes any difference
in actual efficacy in treatment of
patients.
5. Hako-Med has filed a federal lawsuit
against Axiom for patent and trademark
infringement. Hako-Med has won an
injunction for the trademark
infringement and the patent infringement
claim against Axiom will go to trial in
June of 2008.
6. Hako-Med will not allow any of its
intellectual property to be infringed
and is pursuing legal avenues to have
any devices proven to contain stolen
intellectual property pulled from the
market.
7. Axiom is under FBI investigation
which is public knowledge as published
by the Tampa Tribune on March 3, 2007.
